General Terms and Conditions

1. General Information

(1) These General Terms and Conditions (GTC) apply to all offers and services on the online platform www.dressrosa.shop. The customer's own terms and conditions shall not apply unless expressly agreed upon.

(2) In case of individual contractual agreements between the parties, these shall take precedence over the General Terms and Conditions.

2. Conclusion of Contract

(1) The service descriptions on the website www.dressrosa.shop do not constitute a binding offer to conclude a purchase contract. A binding offer is only made when the customer submits an online order via the contact form or places an order in writing or by telephone. The confirmation of receipt of the order does not constitute acceptance. The contract is only concluded when we send the customer an order confirmation. The customer is no longer bound by their offer if we do not send them a declaration of acceptance within five calendar days after receipt of the order.

(2) If an acceptance declaration reaches the customer late but would have arrived on time with regular transport and they should have recognized this, they must inform us immediately after receipt of the declaration about the delay. If the customer delays the notification, the acceptance shall be considered on time. Otherwise, the delayed acceptance shall be considered a new offer for concluding a purchase contract, which the customer may accept by express acceptance or by receiving the goods.

3. Governing Law

The contractual relationship between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection regulations of the country in which the customer resides provide otherwise.

4. Prices, Payment, Delivery, and Shipping Costs

(1) All prices include the applicable value-added tax (VAT) at the time of ordering.

(2) The following payment methods are available:

  • Apple Pay

  • Google Pay

  • Credit Card

  • Prepayment

  • Giropay

  • Paydirekt

  • PayPal

(3) We deliver both within Germany and internationally.

(4) The delivery is carried out by DHL, UPS, postal services, or a company-specific forwarding agent.

(5) Packages with a volume exceeding 1 square meter are usually delivered by a forwarding agent. Please note that bulky goods are not carried into the house.

(6) Shipping costs can be viewed in the navigation under "Payment and Delivery" as well as in product descriptions.

5. Returns

(1) When returning the goods and accessories, it is recommended to use the original packaging if possible, even if it has been damaged due to opening for function testing.

(2) The prepaid and addressed return label included with the delivery should be used for returns. While this is the simplest and most cost-effective method, it is not mandatory. If a significantly more expensive return method is chosen unnecessarily, additional costs may be charged to the customer.

6. Retention of Title

(1) We retain ownership of the delivered goods until full payment of all claims arising from the purchase contract has been received. If the buyer does not fulfill their contractual obligations, particularly in case of payment default, we reserve the right to reclaim the delivered goods. In this case, the buyer is obliged to return the goods.

(2) The buyer must immediately notify us if the purchased item is seized by third parties or otherwise claimed, to enable us to enforce our rights.

7. Transport Damages

(1) If delivered goods show obvious transport damages, they must be reported immediately to the carrier. Additionally, we should be contacted as soon as possible.

(2) Failure to report a complaint or contact us regarding obvious transport damages does not affect statutory warranty rights. However, it assists us in asserting claims against the carrier or transport insurance.

8. Liability

We assume unlimited liability for damages caused by us, our legal representatives, or vicarious agents in the following cases:

  • Injury to life, body, or health

  • Intentional or grossly negligent breach of duty

  • Guarantees, if agreed

  • Applicability of the Product Liability Act.

For breaches of essential contractual obligations due to slight negligence, liability is limited to foreseeable damages typical for the contract. In all other cases, claims for damages are excluded.

9. Warranty Rights

(1) If a product is defective upon delivery (warranty case), Dressrosa Shop will, at the customer's choice, provide either a free repair or replacement. A warranty case does not exist if the product had the agreed-upon condition at the time of transfer. Certain cases are not considered warranty cases, such as damages due to improper use, extreme conditions, electrical influences, or other external factors.

(2) Dressrosa Shop does not assume any warranty for defects caused by unauthorized repairs.

(3) If the customer demands an unreasonable form of remedy, considering the product price, contract content, and good faith, their right is limited to the other form of remedy. Dressrosa Shop reserves the right to refuse this remedy under the same conditions.

(4) The defective product must be sent to the designated return address at Dressrosa Shop’s expense. Before sending, customers must remove any inserted items. Dressrosa Shop is not liable for lost personal items.

(5) If a defective product is returned for replacement, and the customer has used it in a flawless condition before returning it, they must compensate for its use. Further compensation may be required for damages unrelated to the defect.

(6) If the customer fails to meet their return obligation, they are liable for any resulting damages.

(7) If the repair or replacement does not bring the product into a contractually compliant condition within a reasonable time, the customer may withdraw from the contract or reduce the purchase price.

(8) Additional claims against the manufacturer may exist under separate warranty terms.

(9) The legal warranty period ends two years after delivery.
